attempts in any way to trick you into revealing it.
- If you choose to have a face-to-face meeting with
another member, always tell someone in your family or a
friend where you are going and when you will return. Never
agree to be picked up at your home. Always provide your own
transportation to and from your date and meet in a public
place with many people around.
Terms of Service
Welcome to Pounced.org, the place for furs to meet. By
visiting, or using the services of Pounced.org you agree
to abide by all the Terms of Service below along with
any rules posted on site. By creating an account you
indicate your full acceptance of the Terms of Service
and agree to abide by all rules posted on the site. For questions regarding the

1. Eligibility
Membership is void where prohibited. You
agree that you are of legal age in your country or state
of resident and eligible to accept this agreement and
will abide by its terms. You agree that are at least
18 years of age or older.
2. Term
This agreement will remain in full force and effect
while you use this site and/or are a member. You may
terminate your membership at any time, for any reason by
contacting the site administrators. Pounced.org may terminate
your membership for any reason.
This agreement will
remain in effect even if you have terminated your
account and or usage with Pounced.org.
3. Usage and availability
3.1 This website is for use by the general furry
community, and may not be used by organizations
or individuals who are: members of the press or those
interested in prosecution and/or defamation of the furry
community.
3.2 Minors or individuals under the age of 18, may not use
Pounced.org for any purpose and are explicitly forbidden
from using or becoming a member of Pounced.org. Pounced.org will immediately terminate
any member account that is believed to be in violation of this clause,
and may pursue other administrative actions.
3.3 Pounced.org makes not warranties, expressed or implied,
as to the quality, availability, or accessibility of
services, features and resources provided.
4. Content
4.1 Content Rights
Data posted by members to Pounced.org
remains the property of those members, and might not be in
the public domain. As such you may not copy, redistribute or
sell member information, with out explicit written permission
from each member involved.
4.2 Content Posted to the Site
4.2.1 You understand and agree that Pounced.org may delete and
or review, or modify any data posted to Pounced.org. It is the sole
judgment of Pounced.org how and which data is posted, modified and or deleted.
4.2.2 By posting data to Pounced.org, you agree to allow
Pounced.org to redistribute, copy, analyze, and display
your data to other users, regardless of type or sensitivity of
the data in question.
4.2.3 Data posted or derived from or created as a result of
your use of Pounced.org may be retained beyond the
lifetime of your membership term. This data includes
but is not limited to: forum posts, logs,
administrative data, account information, and other
such data. Pounced.org at its sole discretion may
remove such information upon request or in process of
administrative support of Pounced.org.
4.2.4 You are solely responsible and liable for the content that you
publish or post to Pounced.org, or transmit to other users.
4.2.5 You may not post or publish data to Pounced.org
that contains advertisements, street addresses,
legal names or business names, without explicit permission
from Pounced.org.
4.2.6 You agree not to post any explicit data such as
pornography to any area of the site. What is explicit, is
the sole judgment of Pounced.org.
4.2.7 You agree to use Pounced.org in a manner
consistent with any and all applicable laws and regulations.
4.2.8 You may not post, distribute or reproduce copyrighted
material, trademarks or other proprietary information using
resources provided by Pounced.org. If you believe that data
posted on Pounced.org violates a copyright or trademark on
your work please contact the site administrators at
pounced@pounced.org to have the violation investigated.
Pounced.org is not liable for data posted or published by any user.
4.2.9 Pounced.org is not responsible for the accuracy, quality,
content or any other attribute of content or data on the web site,
whether posted by users of the site or Pounced.org and its
associates. Pounced.org is not responsible for any
interruptions of service, regardless of reason.
4.2.10 You agree not to use Pounced.org for illegal purposes or for
the furtherance of illegal activities as defined by the statutes of the
State of Colorado, the United States of America and any agreements with
foreign powers in force by the United States of America.
4.2.11 You agree not to use Pounced.org for advertisement of commercial services
without explicit written permission from Pounced.org.
5. Usage
5.1 You may not harm or attempt to harm minors in any way,
including without limitation, establishing or attempting
to establish unlawful contact with minors (whether on or off
of Pounced.org). All complaints will be reported to law
enforcement agencies.
5.2 You agree not to harass any user, business, member or other
entity, by using resources of Pounced.org. Harassment for these purposes includes,
but is not limited to: excessive contact, actions that are disturbing, threatening, unwanted,
defaming, make false claims, make libelous statements, or continue
after receiving requests to stop from any user. Pounced.org is not liable for any
administrative action as a result of a user complaint of harassment.
5.3 You are solely responsible and accept all liability for
your interactions with other users of Pounced.org.
5.4 You agree that by using Pounced.org you may be exposed
to data or content that is objectionable, obscene, offensive
or otherwise explicit, and that Pounced.org is not liable for
such data or exposure to such data.
5.5 We are not liable for your actions nor actions of any
third party or user.
5.6 Unauthorized access or attempts to access unauthorized
member accounts is strictly prohibited and may result in
administrative action and/or be reported to appropriate law
enforcement agencies.
5.7 Unauthorized uses of Pounced.org including, but not limited to,
collecting member information, email addresses, forum
posts, user posted information, personals ads, or any other
resources made available by Pounced.org, by any means
including but not limited to automated software programs,
or manual methods is strictly prohibited. Pounced.org may
take any administrative action and/or report such activities to
appropriate law enforcement agencies.
5.8 You agree that you, will not attempt to gain unauthorized
access, impair access to, resources
or systems provided by or used by Pounced.org. You agree
to be held liable for such actions. Pounced.org may take
any administrative action and/or report such activities to

5.9 You agree that you will not attempt to defeat or circumvent
any security controls and rules, provided, deployed or
enforced by any functionality on Pounced.org. You agree to be
held liable for such actions. Pounced.org may take any

5.10 You agree that you will not distribute, sell, disassemble
or otherwise attempt to derive source code from the software
supporting Pounced.org. You agree to be held liable for such
actions. Pounced.org may take any administrative action
and/or report such activities to appropriate law enforcement
agencies.
5.11 Continued use of Pounced.org, including but not limited
to logging into a member account, viewing data posted by
other members or accessing any resource provided by
Pounced.org constitutes your agreement and acceptance of
the Terms of Service.
5.12 Donations to Pounced.org may be used for any costs associated
with the operation of Pounced.org. In no way are donations
to Pounced.org required or represent payment for services.
5.13 Pounced.org may discontinue service, at its own discretion,
to any user or member at any time with or without notice or
explanation.
6. This Agreement
6.1 If any part of this agreement is found to be invalid
or non-enforceable, the rest of the agreement will remain in
force.
6.2 Pounced.org reserves the right to modify these Terms of Service at
any given time, with or without prior notice.
6.3 For any Claim, excluding Claims for injunctive or other equitable relief,
where the total amount of the award sought is less than ten thousand U.S. Dollars
($10,000.00 USD), the party requesting relief may elect to resolve the Claim in a
cost-effective manner through binding non-appearance-based arbitration. A party
electing arbitration shall initiate it through an established alternative dispute
resolution ("ADR") provider mutually agreed upon by the parties. The ADR
provider and the parties must comply with the following rules: (a) the arbitration
shall be conducted, at the option of the party seeking relief, by telephone, online,
or based solely on written submissions; (b) the arbitration shall not involve any
personal appearance by the parties or witnesses unless otherwise mutually agreed by
the parties; and (c) any judgment on the award rendered by the arbitrator may be
entered in any court of competent jurisdiction.
6.4 You and Pounced.org agree to submit to the exclusive jurisdiction and venue of
the courts located in the City and County of Denver, Colorado, except as provided
in Subsection 6.3 above regarding optional arbitration. Notwithstanding this, you
agree that Pounced.org shall still be allowed to apply for injunctive or other
equitable relief in any court of competent jurisdiction.
6.5 This agreement and any operating rules for Pounced.org established by
Pounced.org constitute the entire agreement of the parties with respect to the subject
matter hereof, and supersede all previous written or oral agreements between
the parties with respect to such subject matter.
6.6 You agree that if you do not comply with
the Terms of Service and all posted rules, you will liable for all resulting damages and attorney fees,
incurred by you, Pounced.org and/or it associates.
6.7 This agreement shall be construed in accordance with the laws of the
State of Colorado, without regard to its conflict of laws rules. No waiver by either
party of any breach or default here-under shall be deemed to be a waiver of any preceding
or subsequent breach or default. The section headings used herein are for convenience
only and shall not be given any legal import.
6.8 You agree to indemnify and hold Pounced.org, affiliates, officers, agents,
and other partners, employees, volunteers harmless from any loss, liability, claim,
or demand, including reasonable attorney's fees, made by any third party due to or
arising out of your use of the service in violation of this Agreement and/or arising
from a breach of these Terms of Service and/or any breach of your representations
and warranties set forth above.
Definitions

- An individual who has an account with Pounced.org. A member is also a user.
- User
- Any individual who accesses, visits or otherwise uses resources provided or associated with Pounced.org. Users may or may not be members.
